      I completed a SSA for a client on a site located at the highest point on wet enough land. The subsoil is not great but had a T value of 75. I did a P-test then, got a value of 42 and submitted a raised bed with imported soil and all should have been well. The council refused permission based on "ponding on site". Eventhough I am going off the CoP and ticking all the boxes they are refusing planning on those grounds. What are my options?

      Under Section 2.1.2 of Part H of Technical Building Regulations states "In general, the design and installation of wastewater treatment systems for single houses should comply with the relevant parts of the Environmental Protection Agency’s (EPA) Code of Practice 2009 Wastewater Treatment and Disposal Systems Serving Single Houses."

      From what I can see Waterford Co Co are making their own modifications/interpretations to the Code of Practice.

      So if I were you I would make an appeal to An Bord Pleanala and let them decide if

      a) Waterford Co Co (and by default other LA's) can interpret the Code as they see fit
      Or
      (b) We and by “We” I mean all those involved in both the assessment and policing of wastewater applications need to work within the published Code of Practice.

      If the answer is (a) it will make an UTTER mockery of the Code of Practice!

      If they are applying a maximum T-Value of 50, the council are disregarding the ministers direction to apply the CoP to all applications. And while the site assessment is very much a risk assessment and can vary from person to person, I don't believe there is any room for re-writing the CoP in this manner.

      Thanks for your comments re above. I will go to an bord pleanala and see what the outcome is. The result should be interesting! I'll keep ye updated with how i get on.

      One last thing. You might think this is overkill but I would also get a hydrologist to look at your site assessment and pen a letter on their headed paper that basically outlines the fact that there are no hydraulic issues on the site.

      It will be the cheapest money your client ever spends for a few pages of A4 paper and I believe it will hold serious weight with ABP. (so long as the hydrologist is singing from the same sheet as you!)

      If you want a name and no I'll give you a call of a very competent and respected hydrologist.
